🍬 TERMS & CONDITIONS (Allgemeine Geschäftsbedingungen – AGB)

1. Scope and Applicability

These Terms and Conditions (“T&Cs”) govern all contractual relationships between CandySodas (hereinafter “we”, “us”, or “the seller”) and customers who place orders via our online shop available at:

By accessing our website and placing an order, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions in their version valid at the time of the order.

These Terms apply exclusively. Any conflicting or deviating terms of the customer shall not be recognized unless explicitly agreed to in writing.

2. Offer and Conclusion of Contract

The presentation of products within our online shop, including descriptions, images, and pricing information, does not constitute a legally binding offer but rather an invitation to the customer to submit a purchase request.

A binding contract is concluded only when the customer completes the ordering process and subsequently receives an order confirmation via email from us. This confirmation constitutes acceptance of the offer.

We reserve the right to refuse or cancel orders at our sole discretion, particularly in cases where:

     

      • product information contains errors

      • pricing inaccuracies occur

      • items are no longer available

      • there is suspicion of misuse or fraudulent activity

    In such cases, any payments already made will be refunded accordingly.

    3. Prices and Payment Terms

    All prices displayed on our website are stated in Swiss Francs (CHF) and include applicable value-added tax (VAT), unless otherwise indicated.

    Payment must be made in full at the time of purchase using one of the available payment methods provided during checkout, which may include credit or debit card payments (processed via Stripe), PayPal, TWINT, or other supported providers.

    The processing of payments is carried out through secure third-party payment providers, and we do not store complete payment details ourselves.

    Orders will only be processed and shipped once payment has been successfully completed.

    4. Shipping and Delivery

    Delivery of goods is carried out within Switzerland, unless otherwise stated.

    Shipping costs are calculated as follows:

       

        • CHF 6.50 for orders below CHF 200

        • Free shipping for orders of CHF 200 or more

      Delivery is typically completed within 2 to 5 working days, although this timeframe is indicative and not legally binding.

      Delays may occur due to circumstances beyond our control, particularly those attributable to shipping providers or unforeseen logistical issues. In such cases, we shall not be held liable for any resulting delays.

      5. Nature of Products and Product Information

      The products offered in our shop, including imported sodas and candy, may differ from locally available products in terms of ingredients, labeling, and nutritional information.

      Customers are responsible for carefully reviewing product descriptions, ingredient lists, and any allergen information prior to purchase.

      We assume no liability for adverse reactions, allergies, or damages resulting from improper handling, storage, or consumption of the products.

      6. Age Restriction

      By placing an order through our website, you confirm that you are at least 18 years of age or that you have obtained the consent of a parent or legal guardian to make the purchase.

      7. Right of Withdrawal and Returns

      Customers have the right to return products within 14 days of receipt, provided that the following conditions are met:

         

          • the products remain unopened

          • the original packaging is intact

          • the items are in resalable condition

        Before returning any items, the customer must contact us via email at info(at)candysodas.ch.

        Return shipping costs are borne by the customer, unless the return is due to an error on our part (e.g., incorrect or defective product).

        Refunds will be issued only after the returned goods have been received and inspected.

        We reserve the right to refuse returns that do not meet the above conditions.

        8. Customer Accounts

        Customers may create a personal account in order to facilitate future purchases and manage their order history.

        The customer is responsible for maintaining the confidentiality of their login credentials and for all activities carried out under their account.

        We reserve the right to suspend or delete accounts in cases of misuse.

        9. Liability

        To the extent permitted by applicable Swiss law, we exclude liability for indirect, incidental, or consequential damages, including but not limited to loss of profit or business interruption.

        Liability for damages resulting from intent or gross negligence remains unaffected.

        Furthermore, we assume no liability for damages arising from improper use of products or failure to follow product-related instructions.

        10. Data Protection

        The processing of personal data is carried out in accordance with our Privacy & Cookie Policy, which forms an integral part of these Terms and Conditions.

        11. Applicable Law and Jurisdiction

        These Terms and Conditions are governed exclusively by Swiss law, excluding any conflict-of-law provisions.

        The place of jurisdiction shall be the registered office of CandySodas, unless mandatory legal provisions provide otherwise.

        12. Amendments

        We reserve the right to amend these Terms and Conditions at any time.

        The version published on our website at the time of the order shall apply.
